What is ESI registration?

Employee State Insurance Corporation, an independent agency under the Ministry of Labour and Employment of the Government of India, is in charge of managing and regulating employee state insurance (ESI). For Indian employees, the ESI plan was established, which gave the worker financial, medical, and other benefits from the company.

Currently, it is mandatory for any business, organization, or factor that employs more than 10 people and pays them a minimum salary of Rs. 21,000 to register with the ESIC.

Who is eligible to obtain ESI registration in India?

Having more than 10 employees is required to be eligible for ESI registration. In some areas, businesses can register for ESI only if they have more than 20 employees. Here are some additional requirements that must be met in order to be registered for ESI.

  • With the assistance of the employer, an employee whose gross monthly pay is up to Rs. 21,000 may benefit from this.
  • The establishment is registered with the EPFO.

    • 4.75% by the employer
    • 1.75% of the employee
  • All employees with a salary of less than Rs. 21,000 are required to register for ESI in industrial units where there is a risk of accident or health difficulties.

Documents required for obtaining ESI registration

The list of supporting documents that the employer must submit with the application in order to receive ESI registration in India is as follows:

Definition of Factory under ESI Act

Any location where ten or more people are working or were working for pay on any day during the previous year and where a manufacturing process is being carried out, with or without the use of power, is referred to as a factory. The departments would separate from the factory if they were located on the same factory grounds and were working on tasks related to or incidental to the plant's manufacturing process.

This ESI definition of a factory includes a seasonal factory that operates for a period of not more than seven months per year and is involved during that time in any process related to the blending, packing, or repacking of tea or coffee or other manufacturing processes that are processes that are process notified by the central government.

According to the definition, a railway running shed or the operation of the Mines Act, 2952, mines are not covered in this description.

Definition of Establishment under ESI Act

Therefore, businesses with less than 20 employees who make less than Rs. 21,000 a month in pay should not register for ESI.

According to the ESI Act, stores must also be registered. A store is any location where economic operations that result in a sale or a purchase are conducted, according to the supreme court. Therefore, providing services to the consumer is a shop's primary defining characteristic. Therefore, ESI registration in India is required for service providers like advertising agencies, liaison offices, consulting services, and real estate services.

Hospitals, dispensaries, auditors' and attorneys' offices, chartered accountants' offices, and private commercial hospitals are not permitted in this educational institution.

Benefits of ESI registration in India

What are the advantages of getting ESI registration in India?

Employees who are registered with ESI are eligible for a variety of benefits under the Employees State Insurance corporation plan.

Medical Aid- The enrolled ESI members and their families benefit from comprehensive medical care and insurance starting on the first day of employment. On payment of a Rs. 120 annual premium, retired members, permanently disabled covered individuals, and their spouses may also receive medical care.

Maternity benefit- Maternity benefits are available to expectant mothers and are paid for up to 26 weeks. This maternity leave term may be extended by 30 days, subject to medical approval, at the rate of the full wage paid for 70 days the year prior.

Disablement benefit- 90% of the wage is payable starting on the day of employment, regardless of whether any contributions have been made, as long as the temporary handicap persists. The monthly payment for a permanent disability compensation is 90% of the earnings.

Sickness benefits- A maximum of 91 days off from work each year, plus 70% of the monthly salary, are permitted due to illness.

Dependent benefits- In the event of a sudden death during employment, the deceased employee's dependents will be given 90% of their monthly wage.

Funeral expenses- The dead employee's family members are entitled to an extra Rs. 10,000 for funeral costs.

Confinement expenses- If an insured woman or the employee's wife is confined and there are no medical facilities available, confinement fees may be claimed under the ESI program.

Here are some need-based benefits:

Vocational Rehabilitation: Employees with a permanent physical disability who are covered by insurance are entitled to vocational rehabilitation training at VRS.

Physical Rehabilitation: can be used by employees in the event of physical impairment, injury, or risks arising from working.

Old Age Medical Care: Medical benefits can be obtained by ESI employees or those choosing VRS/ERS by making an annual contribution of Rs. 120. The same is also available to members who retire due to a permanent handicap.

Extended Sickness Benefits: Employees with prolonged sickness benefits who have chronic illnesses may get them for up to two years, provided that their 91-day sick leave has already expired.

Enhanced Sickness Benefit: A measure to induce ESI employees to have a vasectomy or a tubectomy for the sake of the family was the enhancement of their sick leave benefits. If there are any post-operative difficulties, an extension of this benefit may be requested.
